On August 2nd 2018 Marques Johnson was illegally arrested by the Pasco County Sherrifs in Port Richey Florida for resisting arrest as the sole charge. Not being charged with a crime, ther was no arrest to resist. Johnson was acquitted of the charge and subsequently filed a lawsuit against the Pasco County Sheriffs office. The Sheriff didn't bother to defend the illegal arrest and simply claimed qualified immunity. The US district court judge rightfully denied the claim. The Sheriff appealed to the 11th circuit court of appeals. Johnson took the bold step of not only arguing that the Sheriff is not entitled to qualified immunity but that qualified immunity itself is not legal. In a 2-1 split the 11th circuit reversed the lower courts decision and granted qualified immunity. Johnson is appealing to the United States Supreme Court. This case if heard by the supreme court could decide once and for all the legality of qualified immunity. However it cost money to take a case to the supreme court.
